Victory: Poland’s top court bans nearly all abortions

If you want a good example of how important pro-life judges are, consider this phenomenal news out of Poland. From the BBC:

Poland’s top court has ruled that abortions in cases of foetal defects are unconstitutional. Poland’s abortion laws were already among the strictest in Europe but the Constitutional Tribunal’s ruling will mean an almost total ban. Once the decision comes into effect, terminations will only be allowed in cases of rape or incest, or if the mother’s health is at risk.

Rights groups had urged the government not to increase restrictions. The Council of Europe’s commissioner for human rights said the day marked a “sad day for women’s rights”…A legal challenge against the 1993 law permitting abortion in cases of severe foetal disabilities – which accounts for 98% of terminations carried out in Poland – was launched by MPs from the ruling nationalist Law and Justice.

There are roughly 1,000 abortions per year in Poland—although some women do leave the country to seek an abortion elsewhere—and the vast majority of them are performed on pre-born children with “defects” of some kind. This ruling essentially affirms that this is not grounds for ending a pre-born child’s life and is a strong rebuke to the ableism inherent in the arguments made by abortion advocates.

A victory for human rights.

Using this photo is pretty awaful, Jonathon. Thousands are outraged as the 5th day of protests now sweeps the whole country. Hopefully this would finally mean Poland going secular for good.

Thousands are outraged. Millions are happy. That is a Polish photo of the March for Life and Family, which the president participated in.

On the other hand, perhaps Americans unhappy with this decision will think twice about packing the Supreme Court (or voting for the political party with a secret plan to do so). An originalist-majority Supreme Court would likely overturn Roe v. Wade and return the issue to elected levels of government, but a right-wing political party could go much further once the court-packing toothpaste is out of the tube and the pendulum swings the other way.
